Today the House is considering, HR 4040, the Consumer Product Safety Modernization Act. The bill creates the TOUGHEST lead standard in the world for children’s products, requires mandatory safety standards for nursery products (e.g., cribs and high chairs) and after review for toys, requires mandatory third-party testing of children’s products, requires tracking labels to aid recalls, prohibits the sale and export of recalled products, improves public notice, protects rights of injured consumers to sue bad actors, strengthens the Consumer Product Safety Commission (CPSC) and provides CPSC with urgently needed resources, and bans travel by CPSC Commissioners and staff that is paid for by an organization regulated by the CPSC.

Cecilia Leibovitz was planning to sell bunches of her lovingly handcrafted bunnies this Easter, but new CPSIA lead testing regulations have threatened the existence of the cute critters. Her business, Baby Fairies, stopped making them because the testing is so expensive.
Leibovitz and her partner, Michael Secore, also run an online store called Craftsbury Kids, which represents about 100 artisans and handcrafters who make toys and clothing.

Cecilia Leibovitz has been instrumental in the grassroots movement to modify the Consumer Product Safety Improvement Act 2008 which will go into effect February 10, 2009. Prohibitively costly lead testing will potentially put out of business thousands of handcrafters, artisans and small businesses which produce and sell children’s products.
Cecilia Leibovitz’s idea to “Save Small Business from the CPSIA” was a winner in the recent Ideas for Change in America Competition on the website change.org. The top ten causes which received the most votes from the public will be presented to US President Barack Obama.

Fox News retail analyst Hitha Prabhakar (former writer for Forbes) claims the CPSIA’s new lead testing law “isn’t going to affect the children’s clothing industry that much.” She thinks that much of the testing has already been done. When asked by the commentator, Prabhaker admits “it will have a pretty strong impact on small businesses…especially if they can’t afford that” (the testing, but) “this is a very small portion of the market.”

CPSIA 2008′s new safety laws are hurting local toymakers and businesses.
Katie Steuernagle of Rochester, Minnesota makes and sells handmade toys out of her home and is concerned that CPSIA 2008′s new testing standards will be so costly, she will be put out of business.
Katie, who appeared on the Martha Stewart show last week (December 2008) said she started the business as an alternative to Chinese imports, which proved last year to be the impetus for the new strict lead testing laws that go into effect February 10, 2009.
