CPSIA 2008′s new safety laws are hurting local toymakers and businesses.

Mel Taber of Camillus, NY runs a toymaking business out of his home and is concerned that CPSIA 2008′s new testing standards will be so costly, he will be put out of business.

My Fox Chicago delves into the new regulations set by the CPSIA 2008 on lead testing for toys. Besides giving information on how parents can check to see if the toy they plan to put under the Christmas tree is safe, they talk to Rick Woldenberg, Chairman, of Learning Resources. Woldenberg is concerned that the CPSIA has not made provision for handcrafters, artisans and small manufacturers of childrens items and the strict mandatory testing will put many out of business.

Kelsey Briggs was born in Oklahoma on December 28,2002 after her parents Lance Briggs and Raye Dawn Smith were divorced.

At the end of 2004 Raye Dawn Smith started dating a man named Michael Lee Porter, whom she met at a local bar.

The first reported incident of child abuse regarding Kelsey was made on Jan.17,2005.

DHS confirmed Kelsey was abused and stated her mother Raye Dawn was the perpetrator due to her conflicting stories of Kelsey’s injuries.

Kelsey Briggs grandmother Kathie Briggs was granted emergency custody Jan.24,2005.

Raye Dawn Smith married Michael Lee Porter on April 18,2005.
Kelsey was having overnight visitation with Raye and Porter even though a court order stated Porter was not to be around Kelsey.

On May 3,2005 Kelsey was taken out of her grandmother Kathie’s care by OKDHS.

Kelsey was put in protective custody because of her broken legs that were confirmed from abuse.

May 4,2005 Kelsey was then moved to her maternal Grandmother Gayla Smith.

Kelsey suffered months of documented abuse.

June 15,2005 Judge Craig Key went against DHS recommedation and sent Kelsey back home to her mother and stepfather.
The judge confirmed Kelsey was being abused and stated,
“Perpetrator Unknown.”

Kelsey was visited by a social worker approximately once every week.

Kelsey’s biological father Lance Briggs was a soldier in Iraq he was undergoing care at a treatment facility for a back injury and was in the process of checking out from his duty in Fort Benning,Georgia.

Lance was schedueled to be home within
a week or two.

On October 11,2005 Kelsey was murdered.
Raye Dawn and Michael Porter were the only ones who had contact with Kelsey in the hour leading up to her death.

The cause of death was blunt force trauma to the abdomen,it was ruled a Homicide.

Two weeks later Porter was arrested on first degee murder.

Kelsey’s mother Raye Dawn was later charged with two felonies, Child Neglect, and, Enabling Child Abuse.

In April of 2006 Kelsey’s body was exhumed for a second autopsy where sexual abuse was documented.
The Stepfather’s charges were amended to add the sexual abuse.

Porter and Smith divorced after Kelsey’s death.

On February 2,2007 a plea negotiation was entered and approved by the paternal family.
The stepfather plead guilty to a reduced charge of Enabling Child Abuse and received 30 years in prison.
He has no possibility of parole for 25.5years.

Kelsey’s mother Raye Dawn Smith went on trial July 9,2007.
She was found guilty of enabling child abuse, she will serve 27 years in prison, without the possibility of parole for 23 years.

Jennifer O’Neill interviewed by Chrisagis Brothers puppets.

Brian Pharoah fondly remembers playing with handmade wooden toys made by his grandfather. Pharoah started looking for toys reminiscent of his childhood and subsequently started an online wooden toy business called realwoodentoys.com. But will the CPSIA testing laws chip away at Pharoah’s wooden toy suppliers so badly, he will end up with a skeleton of his pride and joy?

Hundreds of workers from the childrens garment industry in New York protested the Consumer Product Safety Improvement Act which will go into effect February 10, 2009. Spokesman Cory Silverstein of Kids Headquarters said the consequences of the CPSIA will be grave.

Despite the one year stay of enforcement for lead testing and certificates of content which the Consumer Product Safety Commission issued Friday, January 30, 2009, Silverstein stated that millions of pieces of safe product are being shipped back to the manufacturers. As a result, the manufacturers will be forced to destroy perfectly safe clothing at tremendous losses, forcing many to declare bankruptcy. Closed manufacturers means thousands of workers will lose their jobs.

Steve Levy of Star Ride Kids demonstrated the clothing components which would have to be tested and made a call for common sense.

Don Mays of Consumer Union which publishes Consumer Reports Magazine talked to WABC reporter Tappy Phillips and told her that implementation of the regulations was handled badly. He also said that parents don’t have to worry too much about the safety of clothing already in the marketplace.

Jennifer vanVorst enjoys making baby bibs and she likes the bit of income she makes from selling them. Her fabrics are organic and do not contain lead or the other tested chemicals that are part of the Consumer Product Safety Improvement Act’s new regulations.

She fears without exemptions or modifications of the CPSIA, she will be forced to hang up the baby bibs for good.

Cecilia Leibovitz was planning to sell bunches of her lovingly handcrafted bunnies this Easter, but new CPSIA lead testing regulations have threatened the existence of the cute critters. Her business, Baby Fairies, stopped making them because the testing is so expensive.

Leibovitz and her partner, Michael Secore, also run an online store called Craftsbury Kids, which represents about 100 artisans and handcrafters who make toys and clothing.

Cecilia Leibovitz has been instrumental in the grassroots movement to modify the Consumer Product Safety Improvement Act 2008 which will go into effect February 10, 2009. Prohibitively costly lead testing will potentially put out of business thousands of handcrafters, artisans and small businesses which produce and sell children’s products.

Cecilia Leibovitz’s idea to “Save Small Business from the CPSIA” was a winner in the recent Ideas for Change in America Competition on the website change.org. The top ten causes which received the most votes from the public will be presented to US President Barack Obama.
